Let me preface by saying that my comment doesn't apply to Professor B's position, which criticizes the substance of Bush's choice rather than her qualifications. But I think generally, Miers is going to get little support from the academic community. After all, here they are, most of them Ivy League graduates engaged in legal scholarship, only to have a graduate of a law school that I'm guessing is maybe, in the top 50, appointed to the high court.
This reminds me of a conversation I had back in law school when Kennedy was appointed. A very well known professor had come to speak at our law school and after the talk, I was chatting with him and another professor from my school. Both of them were making all these rude comments about McGeorge Law School (where Kennedy was dean), such as whether it was affiliated with McDonalds or had accredation. But beneath the jokes, you could tell that they were seething with envy that they hadn't gotten the call.
I personally am intrigued by the pick which makes me think that with enough hard work and luck, anyone in our profession can make it to the top, not just the ones with John Roberts' type credentials (though don't get me wrong, after having worked on a case with Justice Roberts 5 years ago, I am his absolute No. 1 fan)
